Welcome to the Carranza Academy of Languages LLC.

We invite you to read these Terms and Conditions.

By using our website or interacting with us in any way you are binding yourself by these Terms and Conditions. The Terms and Conditions are a legal contract between you and the Carranza Academy of Languages LLC.

These Terms and Conditions are applicable to every person with whom we interact, including but not limited to users of this website.

DO NOT CONTINUE TO USE THE WEBSITE OR OTHERWISE INTERACT WITH US IF YOU DO NOT AGREE TO ALL OF THESE TERMS AND CONDITIONS.

The Terms and Conditions are divided into sections for your convenience but all of the content applies without regard to the section in which it appears.

Finally, we apologize for the legal jargon. We have tried to write these in simple English but some of the jargon is necessary.

    We will change and/or add to these Terms without notice and all changes and additions apply from the date of posting whether you are aware of them or not.     As long as you comply with these Terms, we grant you a personal, non-exclusive, non-transferable, limited privilege to enter and use the website.

    If you enroll for classes these terms apply to the offer, acceptance and consideration of payment necessary to undertake a learning program.

    You agree that you have accessed this website for your own personal use subject to these Terms and Conditions including our Privacy Policy.

    Unless otherwise stated, Carranza Academy of Languages LLC and its subsidiaries and associated companies, own the intellectual property rights for all material on the website and all materials we make available to you whether through the website or by email, text message, phone call (all media) or any other form of communication. Our intellectual property rights include, but are not limited to pictures, text, graphics, and computer code. All our intellectual property is copyrighted and protected by various other property rights and unfair competition laws. Our logos, both text and symbols, are protected by trademark.


    We specifically prohibit the use of our intellectual property by any person or organization for commercial purposes.

    With respect to our intellectual property you must not:

    Collection and Use of Personal Information from Persons not enrolled with the Academy

    We will ask you to provide personal information such as your name and email address when you contact us. You are not required to provide any personal information, but, if you do not do so, we will not be able to respond to any queries or comments you may have.

    We may share this personal information internally and use it consistent with this Privacy Policy. We may also combine it with other information to provide and improve our products, services, content, and advertising.

    How we use your personal information

    We will not share or sell or allow the use of your personal information by a third party.

    We may process your personal information: for the purposes described in this Privacy Policy; for compliance with a legal obligation to which the Academy is subject; for the performance of a contract to which you are party; in order to protect your vital interests; or when we have assessed it is necessary for the purposes of the legitimate interests pursued by the Academy.

    The personal information we collect allows us to keep you posted on your interactions with us and our latest announcements. If you are not an enrolled student and you don’t want to be on our mailing list, you can opt-out anytime by notifying us at admin@spanishyourway.net.

    We also use personal information to help us create, develop, operate, deliver, and improve our services, content and advertising, and for loss prevention and anti-fraud purposes. We may also use your personal information for account and network security purposes, including in order to protect our services for the benefit of all our users, and pre-screening or scanning uploaded content for potentially illegal content, including child sexual exploitation material.

    Where we use your information for anti-fraud purposes it arises from the conduct of an online transaction with us. We limit our uses of data for anti-fraud purposes to those which are strictly necessary and within our assessed legitimate interests to protect ourselves, our customers and our services. For certain online transactions we may also validate the information provided by you with publicly accessible sources.

    We may use your personal information, including date of birth, to verify identity, assist with identification of users, and to determine appropriate services. For example, we may use date of birth to determine your age in designing your personal lesson plan.

    From time to time, we may use your personal information to send important notices, such as communications about purchases and changes to our terms, conditions, and policies. Because this information is important to your interaction with us, you may not opt out of receiving these communications.

    We may also use personal information for internal purposes such as auditing, data analysis, and research to improve our services and customer communications.

    If you apply for a position as instructor or otherwise we may use your information to evaluate your candidacy and to contact you. If you are a candidate, you will receive more information about how we handle candidate personal information at the time of application.

    We may collect information such as occupation, language, zip code, area code, unique device identifier, referrer URL, location, and the time zone where our website is used so that we can better understand customer behavior and improve our services and advertising.

    We may collect and store details of how you use our services, including search queries. This information may be used to improve the relevancy of results provided by our services. Except in limited instances to ensure quality of our services over the Internet, such information will not be associated with your IP address.

    If we do combine non-personal information with personal information the combined information will be treated as personal information for as long as it remains combined.

    We will treat as non-confidential any feedback or comments provided by individuals not enrolled with us. We shall be free to use such information on an unrestricted basis and, if we incorporate it or similar text in our materials we will copyright it, without attribution.

    Integrity and Retention of Personal Information

    We make it easy for you to keep your personal information accurate, complete, and up to date. We will retain your personal information for the period necessary to fulfill the purposes outlined in these Terms and in any enrollment agreements. We review and purge personal information that is no longer associated with an ongoing relationship at intervals of two years. If you do not accept this policy we might be unable to continue our relationship with you.

    Internet Security

    You understand and acknowledge that internet transmissions are never completely private or secure. You understand that any message or information you send to the Carranza Academy of Languages LLC or our credit card processor may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted.

    Students under the age of 18 may not enroll in any of our courses without the consent of their parent, guardian or other adult authorized to act in their behalf.

    Our communications with enrolled students must necessarily be direct. ).

    We will not send materials nor otherwise communicate with students under the age of 13 without also copying the responsible adult, unless that adult OPTS OUT.

    We will send materials and otherwise communicate with students between the ages of 13 and 18 without also copying the responsible adult, unless that adult OPTS IN.

    Except in special circumstances, we do not copy 3rd parties on materials and other communications between us and students age 18 and older.

The Carranza Academy of Languages LLC is committed to a policy of non-discrimination and we ask that you accept our policy and engage in non-discriminatory behavior when you use this website or otherwise interact with us and your fellow students.

    We do not discriminate against anyone regardless of age, gender, race, creed, color, or national origin. We do not discriminate against persons who identify as members of the LGBT+

    community. We do not discriminate against the differently-abled.

    We do not tolerate harassment of any kind, abusive behavior, bullying, making fun of other students, and so on.

    As teachers of language, we know that words matter; we want you to recognize the same.

    We are aware that some of you might have problems with the use of gender-specific nouns, pronouns and adjectives. We sympathize with you.

    But Spanish is a very gender-specific language. Every noun and pronoun and most adjectives require that gender be expressed. We must teach this way or you cannot become fluent in Spanish. Understand that in teaching Spanish we do not intend to mis-characterize the gender of anyone or anything.

    When you enroll as a student we will create a personal online account for you. You may use your email address for logging in. We will provide a student ID number and a password. You may not change the password. If your password is compromised we will change it for you.

    Maintaining the privacy of your personal online account is important for you. It will include all of your interactions with us, all evaluations of you progress that we make, and so forth. This is personal information. We will not share it with anyone. outside the Academy and you probably don't want to either.

    The security of our website and our confidential information is extremely important to us. See Intellectual Property.

    You are responsible for maintaining the confidentiality of the information you hold for your account, including your password, and for any and all activity that occurs under your account name (your personal email address) as a result of your failing to keep this information secure and confidential. You agree to notify us immediately of any unauthorized use of your account or password, or any other breach of security.

    You may be held liable for losses incurred by us or any other user of or visitor to the website due to someone else using your password or account as a result of your failing to keep your account information secure and confidential.

    You may not use anyone else’s user ID, password or account at any time nor may you authorize anyone else to use your account. We will not be liable and you will be liable for any loss or damage arising from your failure to comply with these obligations.

You agree to the personal jurisdiction by and venue in the state and federal courts in Spokane County, Washington, and waive any objection to such jurisdiction or venue.

    The preceding provision regarding venue does not apply if you are a consumer based in the European Union. If you are a consumer based in the European Union, you may make a claim in the courts of the country where you reside.

    Any claim under these Terms must be brought within one year after the cause of action arises, or such claim or cause of action is barred.

    No recovery may be sought or received for damages other than out-of-pocket expenses, except that the prevailing party will be entitled to costs and attorney’ fees. In the event of any controversy or dispute between the Academy and you arising out of or in connection with your use of the website, the parties shall attempt, promptly and in good faith, to resolve any such dispute.

    If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.
